Sometimes when parents end their marriage, it is difficult for them to agree upon who should have custody of the children. In every child custody dispute, the court considers the child's best interest to be the overriding priority in determining who will receive custody.

To decide what the best interest of the children actually is, the court considers a number of factors including:

● Which parent is most likely to allow the child to have frequent, continuing contact with the other parent
● Whether either parent is or has been abusive
● Whether either parent abuses drugs or alcohol or is involved in any criminal activity
